Dad Bod Paradise has adopted the following general policy towards the infringement of copyright and other intellectual property in accordance with general United States intellectual property laws and the Digital Millennium Copyright Act. Dad Bod Paradise will respond to notices in the form provided below from jurisdictions other than the United States as well.
REPORTING INFRINGEMENTS
Notice Requirements: To report infringements, email legal@dadbodparadise.com with a notice meeting the DMCA requirements, including:
(a) Authorized person's electronic/physical signature. (b) Detailed description of the copyrighted/intellectual property claimed to be infringed. (c) Location of the alleged infringing material on Dad Bod Paradise, detailed enough for us to find it. (d) Your contact details: address, telephone, email. (e) A statement of good faith belief that the disputed use is unauthorized. (f) A declaration under penalty of perjury of your ownership or authorization to act on behalf of the owner.
Dad Bod Paradise's Response: Upon receiving a valid infringement notification, Dad Bod Paradise's Legal Department may remove/disable access to the infringing material. We will attempt to inform the infringing user, providing them with the notice and contact information of the notifier. Repeat infringers may have their rights terminated.
Invalid Notice Consequences: Incomplete or inaccurate notices may be disregarded. Under Section 512(f) of the Copyright Act, knowingly misrepresenting material or activity as infringing may lead to liability.
RESPONDING TO INFRINGEMENTS
Counter Notice Requirements: If you believe material was mistakenly removed, send a Counter Notice to legal@dadbodparadise.com with:
(a) Your physical/electronic signature. (b) Identification of the removed/disabled material and its previous location. (c) A statement under penalty of perjury that the material was mistakenly removed/disabled. (d) Your contact details and a statement consenting to the jurisdiction of the Federal District Court for your district, or any district where Dad Bod Paradise may be found if outside the US. You must agree to accept service of process from the original notifier or their agent.
Reinstatement Procedure: If a valid Counter Notice is received, Dad Bod Paradise may inform the original complaining party and may restore the removed material or cease disabling it, unless an action seeking a court order is filed by the copyright owner.
GDPR Compliance: In compliance with the General Data Protection Regulation (GDPR), users from the European Union have the right to access their personal data held by us, request correction or deletion of such data, and object to its processing. For requests or concerns regarding your data under GDPR, please contact our Data Protection Officer at legal@dadbodparadise.com.
International Jurisdiction Compliance: For users outside the United States, including the EU, Dad Bod Paradise adheres to applicable international intellectual property laws. Please indicate in your notice if the issue pertains to a specific jurisdiction outside the United States.
